By accessing and using the Fit AI Coach Tracker mobile application ("App"), you accept and agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you ("User", "you", or "your") and Fit AI Coach Tracker ("Company", "we", "us", or "our").
These Terms are read together with our Privacy Policy. By using the App, you also agree to our Privacy Policy.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the App for your personal, non-commercial use only.
You must be at least 13 years old to use the App. If you are between 13 and 18 years old (or the age of majority in your country), you must have the consent of a parent or legal guardian. By using the App, you represent and warrant that you meet these requirements.

We reserve the right to disable or suspend any account at our discretion if we believe these Terms have been violated.
We may offer a free trial period for new users. The duration and conditions of the free trial will be displayed in the App at the time of sign-up. After the trial period ends, your subscription will automatically convert to a paid subscription at the selected plan, unless you cancel before the trial ends via your Apple ID account settings.
We offer different subscription plans, such as Basic, Pro Monthly and Pro Annual.
Subscriptions are billed through your Apple App Store account:
You can manage or cancel your subscription at any time using your Apple ID account settings on your device (for example: Settings → [Your Name] → Subscriptions).
Deleting the App does not cancel your subscription.
If you cancel, your subscription will remain active until the end of the current billing period, and you will continue to have access to premium features during that time.
All payments are processed by Apple via the App Store. Any refund requests must be made directly to Apple and are subject to Apple's own refund policies. We do not provide direct refunds ourselves, unless required by applicable law.
Depending on your country of residence, you may have additional statutory consumer rights. These rights are not affected by these Terms.
You may be able to submit or upload content through the App, such as progress photos, notes, comments, or feedback ("User Content"). You retain ownership of your User Content.
By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, display, and process your User Content solely for the purpose of operating, maintaining, and improving the App and our services.
We will not publicly share your personal progress photos or other sensitive personal content without your explicit consent. We may use aggregated and anonymized data (that does not identify you personally) to analyze and improve the App.

All content, features, and functionality in the App, including but not limited to text, graphics, logos, icons, images, audio clips, video clips, data compilations, software, and AI models or algorithms, are the exclusive property of Fit AI Coach Tracker or its licensors and are protected by copyright, trademark, and other intellectual property laws.
Except as expressly permitted by these Terms or applicable law, you may not copy, reproduce, distribute, modify, create derivative works, publicly display, or otherwise exploit any part of the App or its content without our prior written permission.
The App may integrate or interact with third-party services, APIs, or contain links to third-party websites or content. We do not control and are not responsible for:
Your use of any third-party services is at your own risk and may be subject to the terms and privacy policies of those third parties.
Apple Inc. is not a party to these Terms and is not responsible for the App or its content. However, your purchases and subscriptions through the App Store are also subject to Apple's own terms and conditions and policies.
In case of any conflict between these Terms and Apple's terms regarding billing or refunds, Apple's terms may prevail to the extent required by Apple's rules.
To the fullest extent permitted by applicable law, Fit AI Coach Tracker and its affiliates, officers, employees, agents, and licensors shall not be liable for:
Our total liability to you for all claims arising out of or relating to your use of the App shall not exceed the total amount you paid to us (if any) for the App or subscriptions in the twelve (12) months preceding the event giving rise to the claim.
Some jurisdictions do not allow the exclusion or limitation of certain damages or implied warranties. In such cases, the above limitations may apply to you only to the extent permitted by applicable law.
You agree to indemnify, defend, and hold harmless Fit AI Coach Tracker and its affiliates, officers, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in connection with:
We may suspend or terminate your access to the App, in whole or in part, at any time, with or without notice, if:
Upon termination, your right to use the App will immediately cease. Sections that by their nature should survive termination (including, without limitation, intellectual property, disclaimers, limitation of liability, and indemnification) shall remain in effect.
We may update or modify the App from time to time, including adding, changing, or removing features.
We may also modify these Terms. When we make material changes, we will update the "Last updated" date at the top of these Terms and may notify you within the App or by other reasonable means. Your continued use of the App after the updated Terms are posted constitutes your acceptance of the changes.
If you do not agree to the updated Terms, you must stop using the App.
These Terms shall be governed by and construed in accordance with the laws of the Republic of Türkiye, without regard to its conflict of law principles, unless the laws of your country of residence require otherwise for your protection as a consumer.
Any disputes arising from or related to these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of Türkiye, unless mandatory consumer protection laws in your country grant you the right to bring claims in your local courts.
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect. The invalid provision shall be replaced by a valid provision that comes closest to the intent and economic effect of the original provision.
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fit AI Coach Tracker regarding your use of the App and supersede any prior or contemporaneous agreements, communications, and understandings, whether oral or written, relating to the subject matter hereof.
